Pennsylvania Gubernatorial Candidate Dennis Atiyeh Challenges Federal Court Ruling, Raises Questions Over Ballot Access and Department of State Procedures

Motion for Reconsideration Cites Disputed Nomination Documents, Unverified Evidence, and Alleged Administrative Failures That Interfered With Candidate's Access to the Ballot federal case #1:26-CV-2813

HARRISBURG, PA —Pennsylvania gubernatorial candidate Dennis Atiyeh has filed a Motion for Reconsideration in the United States District Court for the Middle District of Pennsylvania, challenging the Court's decision to deny his request for a preliminary injunction in his ongoing ballot-access dispute with Pennsylvania Secretary of the Commonwealth Al Schmidt. Schmidt refers to Atiyeh and other candidates as “BALLOT CLUTTER” in other words ballot trash in Schmidt’s response brief.

The motion, dated October 7, 2026, raises questions about the availability of official nomination papers, the reliability of evidence presented by the Pennsylvania Department of State, and whether administrative delays and conflicting information unfairly interfered with Atiyeh's ability to qualify for the ballot.

Atiyeh argues that the Court's previous ruling was in error, forcing a write in campaign. Atiyeh states, “the minutemen traveled to Philadelphia 250 years ago and gave their lives; for voters to travel to their local voting polls to write in Dennis Atiyeh to save the state and country is modern day bravery.”
